When There's a Foreclosure Date on the File
A foreclosure notice puts a clock on everything. KCEREC works to help the homeowner reach the best available outcome, collaboratively with the servicer and every party on the file, whether the homeowner contacts us directly or is referred by their agent, their foreclosure defense or bankruptcy attorney, an investor partner or a title company. We look at foreclosure alternatives, such as a short sale, a loan modification review or another loss mitigation option, along with any liens, judgments, tax or title issues that stand in the way, while there's still time to weigh them. We can't promise a sale will be postponed or an option approved, but we can make sure the lender has a complete, organized file to decide on. The same process applies whether the property is a home or commercial space.
The Foreclosure Challenge
Foreclosure keeps its own schedule. Notices, sale dates and loss mitigation reviews can all be running at once, and a review doesn't always pause the clock. Meanwhile, the homeowner may be hearing from many people at once and not know whom to trust.
Each professional holds part of the picture. The servicer has its review rules. The agent has a buyer. A second lienholder needs to approve a payoff. Title needs final figures, and an attorney may be watching a court date. When those parts don't line up, files stall, and the homeowner often learns about problems last.
The KCEREC Approach
Start Early
The earlier a file comes to us, the more options are usually still open. We look at the dates first, then everything else.
One Coordinated File
Every party works from the same documents, figures and dates, and every party gets the same updates.
Options, Not One Answer
We look at the paths that may fit: a short sale, a loan modification review, or another loss mitigation option, plus resolving liens, judgments, tax or title issues that stand in the way. If listing the property on the market is the best path, we can connect the homeowner with an agent to help. The lender decides. The homeowner chooses, with their own advisors.
Alongside the Homeowner's Attorney
We don't give legal advice or provide foreclosure defense. We work alongside the homeowner's bankruptcy or foreclosure defense attorney and any other counsel on the file, and we follow the servicer's submission requirements.
Our Foreclosure File Process
Check the Dates and the Liens
We confirm the sale or court date, the loan status, and every lien on the property, then name everyone who has to sign off.
Get Authorization and Open Contact
With the homeowner's written authorization, we contact the servicer and other lienholders on the homeowner's behalf, and work with the agent, title and counsel as needed.
Submit and Negotiate
We submit a complete package and follow up on every request. If a sale date is close, we make sure the servicer knows about the pending file. The servicer decides how to handle the date.
Coordinate the Closing
If an option is approved, we track its conditions and deadlines, collect payoffs and releases, and coordinate with title through closing.

Frequently Asked Questions
How does KCEREC help when a file has a foreclosure date?
We start with the dates. We confirm the dates and liens, get the homeowner's written authorization, submit a complete package to the lender on the homeowner's behalf, and keep every party on the same timeline. The goal is a decision made on a complete file, in time for it to matter.
Can KCEREC stop a foreclosure?
No one can honestly guarantee that. We work to help prevent foreclosure when viable alternatives exist. We're not a law firm and don't provide foreclosure defense. We prepare and negotiate loss mitigation options such as a short sale. Whether a sale date moves is up to the lender and, in some cases, the court. For legal questions, the homeowner should talk to an attorney.
Does a loan modification review stop the sale date?
Not always. Foreclosure timelines can keep moving during a review, depending on timing and the rules that apply. The homeowner should ask the servicer in writing about the status of the sale date and get advice from an attorney or a HUD-approved housing counselor.
Is a short sale better than a foreclosure sale?
It depends on the homeowner. A short sale can give the homeowner more say in how the home is sold, but credit effects, any remaining balance and tax treatment vary by loan, lender and state. We explain how each path works. The homeowner should weigh it with their own attorney, tax advisor or housing counselor.
Is there a foreclosure date on the home?
Homeowners can contact us directly, and professionals can refer a homeowner. Send us the date and the basics. We'll tell you what we'd need and whether there's time to work with.
